DexCare acts solely as a technology platform to provide you with our Services (as defined below), including connecting you with health care professionals and physicians.
This Privacy Policy is designed to help you understand how DexCare, Inc. (“DexCare”, “we”, “us”, or “our”) collects, uses, processes, and shares your personal information, and to help you understand and exercise your privacy rights. Notice at Collection. At or before the time of collection, you may have a right to receive notice of our privacy practices. Please use the embedded links to understand what the categories of personal information we collected, the purposes for which such personal information is collected or used, whether such information is “sold” or “shared” and how to opt-out of such uses, and how long such information is retained.
Supplemental Privacy Notices. DexCare may provide additional privacy notices to individuals at the time we collect their personal information. For example, we may provide a specific privacy notice to participants that describes our privacy practices in connection with health information. These additional privacy notices may supplement this Privacy Policy or may apply in lieu of this Privacy Policy.
Notice Regarding Patient Protected Health Information. In some cases, physicians and other licensed professionals who are registered with DexCare and utilize DexCare Services (as defined below) to deliver in-person care and telehealth services (each a “Clinician”) and/or professional practices (each a “Practice”) may use our DexCare Services to treat or otherwise interact with patients (each a “Patient”). This Privacy Policy does not apply to any protected health information about Patients that is subject to the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”) that we process solely on behalf of Clinicians and/or Practices pursuant to a business associate agreement (“Patient PHI”). The Clinicians’ and/or Practices’ respective notice of privacy practices govern their collection and use of this Patient PHI. Our processing of this Patient PHI is governed by the business associate agreements that we have in place with the Clinicians, Vendors and/or Practices, not this Privacy Policy. Any questions or requests relating to Patient PHI should be directed to the relevant Clinician and/or Practice.
Note that if a Patient asks us to process their Patient PHI outside the scope of their relationship with a specific Clinician and/or Practice, this information may be subject to our Privacy Policy or other supplemental privacy notices we may deliver.
I. Overview
This Privacy Policy applies to personal information processed by us, including on our websites, mobile applications, and other online or offline product and services offerings, such as www.dexcare.com. To make this Privacy Policy easier to read, our websites, web & mobile applications, and other offerings are collectively called the “DexCare Services”, and your use of the DexCare Services is subject to the DexCare Services Terms of Service and this Privacy Policy. Please note that this Privacy Policy applies only to information collected via the DexCare Services. This Privacy Policy is incorporated and made part of the DexCare Services Terms of Service.
II. Changes to our Privacy Policy
We may revise this Privacy Policy from time to time in our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use DexCare Services after the new Privacy Policy takes effect. If you do not agree with this Privacy Policy, do not use any DexCare Service.
III. What information do we collect?
The categories of personal information that we collect depend on how you interact with us, such as when you register on the DexCare Services or otherwise use the DexCare Services in any manner, communicate with us, and the requirements of applicable law.
Personal Information You Provide to Us Directly
- Patient Accounts. If you are a Patient, we may collect personal information in connection with the creation or administration of your account, such as your name, email address, phone number, address, health information, details about your medical history, and any other information that you provide to us or that we otherwise collect.
- Clinician/Practice Accounts. If you are a Clinician or an employee of a Practice, we may collect personal information in connection with the creation or administration of your account, such as your name, email address, phone number, address, professional details, whether you work for or are affiliated with a Practice, and any other information that you provide to us or that we otherwise collect.
- Regulatory Information. We may collect personal information where required to comply with regulatory requirements.
- Purchases. We may collect personal information and details associated with your purchases, including payment information. Any payments made via our DexCare Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our DexCare Services, but we may receive information associated with your payment card information (for example, your billing details).
- Your Communications with Us. We may collect personal information, such as email address, phone number, or mailing address when you request information about our DexCare Services, register for our newsletter, request customer or technical support, or otherwise communicate with us.
- Surveys. We may contact you to participate in surveys. If you decide to participate, we may collect personal information from you in connection with the survey.
- Interactive Features. We and others who use our DexCare Services may collect personal information that you submit or make available through our interactive features (for example, messaging and chat features, commenting functionalities, forums, blogs, and social media pages). Any information you provide using the public sharing features of the DexCare Services will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein.
- Conferences, Trade Shows, and Other Events. We may collect personal information from individuals when we attend or host conferences, trade shows, and other events.
- Business Development and Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential business opportunities.
- Job Applications. We may post job openings and opportunities on our DexCare Services. If you respond to one of these postings, we may collect your personal information, such as your application, CV, cover letter, and/or any other information you provide to us.
Personal Information Collected Automatically
We may collect personal information automatically when you use the DexCare Services. For example, we may collect mobile carrier or internet service provider information, mobile device and browser information, IP addresses (including approximate location derived from the IP address), and other unique identifiers (for example, as used in mobile advertising or cookies as described below). We may also automatically collect information regarding your use of DexCare Services, such as pages that you visit before, during and after using DexCare Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use DexCare Services.
Our Use of “Cookies”
Cookies are small files that a site or its service provider transfers to your computer’s hard drive. Like many web sites and certain mobile apps, we use and may allow third party service providers to use “cookies” as well as local shared objects, web beacons, pixels, single pixel GIFs, clear GIFs, and/or other tracking technologies to enhance your experience and gather information (sometimes known as analytics) about visitors and visits to the DexCare Services, including how you use the DexCare Services (“Usage Data”). This can be through your Web browser or mobile device that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information.
Cookies help us in many ways to make your use of the DexCare Services more enjoyable and meaningful, such as understanding usage patterns and improving functionality of the DexCare Services. For instance, we use cookies to help us understand your preferences based on previous or current DexCare Services activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about DexCare Services traffic and DexCare Services interaction so that we can offer better DexCare Services experiences and tools in the future.
We may contract with third-party service providers to assist us in better understanding our DexCare Service visitors. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the DexCare Services and enhance your experience when you use the DexCare Services. For our DexCare Services that require authentication, we have taken steps, on a best effort basis, to not share health information with Google Analytics, and to anonymize the users IP address.
If you are using our website, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. If you are accessing our services through a mobile app, you can choose to change your permissions and settings on your mobile device. Each browser and device is different, so look at your browser or devices Help or Settings menu to learn the correct way to modify them. If you turn cookies off or disable certain permissions, you won’t have access to many features that may make your DexCare Service more efficient and some of our services will not function properly.
Personal Information Collected from Other Sources
We may collect additional personal information from other sources such as:
Clinicians/Practices. We may obtain personal information about you from other Clinicians/Practices that you interact with via our DexCare Services or that you otherwise direct to share personal information with us.
Third-Party Services and Sources. We may obtain personal information about you from other sources, including through Third-Party Services and other organizations. For example, you may direct a Third-Party Service to share your health information with us.
IV. How do we use your Personal Information?
We use your personal information to fulfill our contract with you and provide you with the DexCare Services, such as in the following ways:
- Connecting you to patient portals to retrieve and download your health data and health insurance data;
- Assisting with the entry of your health data or scheduling of appointments;
- Accessing patient education materials and preventive information;
- Providing a directory listing of Clinicians;
- Conducting patient intake assessments through questionnaires to facilitate symptom-based triage, utilizing patient-provided responses;
- Facilitating chat-based and video-based communication with Clinicians;
- Providing SMS, in-app, and push notification alerts and other types of messages directly sent to you outside or inside the Services if you opt-in to receive them;
- Providing access to our services or products;
- Managing your information and account, which includes personalizing your DexCare Service and allowing us to deliver the type of content and product offerings in which you are most interested;
- Responding to your customer or technical service requests;
- Contacting you with important information as necessary;
- Processing your financial and other requested transactions;
- Verifying and authenticating your identity;
- Administering DexCare Services features or registering you for events;
- Identifying, troubleshooting, and repairing problems with the DexCare Services, or any services as requested;
- Pursuing our legitimate interests such as direct marketing, research and development (including marketing research and analysis of Usage Data) to develop new or improve existing products & services, promote network and information security, and prevent fraud;
- Processing applications if you apply for a job we post on our Services;
- Sharing personal information with third parties as needed to provide the Services;
- Enforcing our Terms of Service, and detecting and protecting against error, fraud and other unauthorized or illegal activities;
- Ensuring quality control; and
- Carrying out activities that are required to comply with our compliance or legal obligations.
Marketing and Advertising our Products and Services
We may use personal information to tailor and provide you with content and advertisements. We may provide you with these materials as permitted by applicable law.
Some of the ways we may market to you include email campaigns, custom audience advertising, and “interest-based” or “personalized advertising” or “targeted advertising” that may be done through cross-device tracking. See below in Privacy Choices and Rights for more information on how to opt-out of such advertising.
Other purposes
We also use your personal information for other purposes as requested by you or as permitted by applicable law.
- With Your Consent. We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent.
- De-identified and Aggregated Information. We may use personal information to create de-identified and/or aggregated information, such as demographic information, information about the device from which you access our DexCare Services, or other analyses we create.
V. How we disclose the information we collect to outside parties
We disclose your personal information to the categories of third parties, as follows:
- To our Service Providers who we engage with to assist us in providing the services to you, such as medical services, IT and web site hosting, credit card payment processing, order processing, analytics services etc.
- To our Business Partners to provide you with a product or service you have requested; we may share your personal information with business partners with whom we jointly offer products or services.
- To our Advertising Partners with whom we may share your personal information. These third-party advertising partners may set cookies and other tracking tools on our Dex Care Services to collect information regarding your activities and your device (for example, your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising”, “targeted advertising,” “personalized advertising,” or “cross-context behavioral advertising.”
- If you access our DexCare Services as an Authorized Users of one of our Clinician or Practice customers, that customer may access information associated with your use of the DexCare Services including personal information, usage data, the contents of communications, files associated with your account, and testing results. Your personal information may also be subject to the Clinician’s and/or the Practice’s privacy policy. We are not responsible for the processing of your personal information by these parties.
- We may share your personal information with our company Affiliates.
- We may use third-party application program interfaces (“APIs”) and software development kits (“SDKs”) as part of the functionality of our DexCare Services. SDKs typically collect your mobile device identifier and information related to your use of the DexCare Services. SDKs may allow third parties including analytics and advertising partners to collect your information for various purposes including to provide analytics services and personalized advertising. For more information about our use of APIs and SDKs, please contact us as set forth in “Contact Us” below.
- In the event of the sale or transfer of DexCare, of one or more of our business units or of some or all of our assets, or in the context of some other business acquisition transaction, as permitted by law or contract.
- In response to lawful governmental requests or legal process (for example a subpoena, court order, or search warrant); to establish or exercise our legal rights, or to defend against claims; or to protect the safety or security of the public or of users of the DexCare Services; or in other circumstances in which we have a good-faith belief that a crime has been or is being committed by a user of our Services, that an emergency exists that poses a threat to the safety of you or another person; or
- When necessary to protect either our rights or our property or for us to render the service you have requested.
Others You Share or Interact With. The DexCare Services may allow you to share personal information or interact with other individuals or Clinicians/Practices. For example, Patients may share personal information with Clinicians/Practices and Clinicians/Practices may interact with Patients. Any personal information provided to Practices and/or Clinicians will also be subject to their terms, conditions, and policies. We are not responsible for the processing of your personal information by other individuals or Clinicians/Practices that you share or interact with.
Third-Party Services You Share or Interact With. Certain features and functionalities of the Services may link to or allow you to interface, interact, share information with, direct us to share information with, access and/or use third-party websites, services, products, and technology (collectively, “Third Party Services”). Third-Party Services may include, but are not limited to, diagnostic laboratories, diagnostic imaging centers, home phlebotomy providers, and pharmacies. Any information shared with or otherwise collected by a Third-Party Service may be subject to the Third-Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services.
VI. Privacy Choices and Rights
Privacy Choices
You can correct or update your personal information by re-registering, using the self-help provided options on your account portal, or by contacting us by e-mail at . It may take us up to 30 days to process your request.
Additional privacy choices you may have about your personal information are determined by applicable law and are described below.
Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or DexCare Services you have requested. We may also send you certain non-promotional communications regarding us and our DexCare Services, and you will not be able to opt out of those communications (for example, communications regarding our DexCare Services or updates to our Terms of Service or this Privacy Policy). When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses. You may opt out of receiving this advertising by visiting https://app.retention.com/optout.
Text Messages. We may use SMS or MMS Text Messages for Multi-factor authentication, for transactional purposes, and for delivery of our Services.
Mobile Devices. We may send you push notifications through our mobile application. You may opt out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information via our mobile application. You may opt out of this collection by changing the settings on your mobile device. However, we strongly recommend you do not opt out of push notifications, as notifications are used for the delivery of our DexCare Services.
“Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
Cookies and Personalized Advertising. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. However, if you adjust your preferences, our DexCare Services may not work properly. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements on some mobile applications by following the instructions for Android, iOS, and others.
The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. Please note you must separately opt out in each browser and on each device.
Google Business Profiles Integration Opt-Out
If your website or application using the DexCare Services includes an integration with Google Business Profiles, then you also have the following opt-out rights regarding your integration feed:
- DexCare will remove you from our integration feed should we no longer have a contractual relationship in place, or you request to be removed from our integration feed.
- If you suspend or discontinue our service, we will remove you from our integration feed within 5 business days.

In accordance with applicable law, you may have the right to:
- Confirm Whether We Are Processing Your Personal Information (the right to know);
- Access to and Portability of Your Personal Information, including: (i) obtaining access to or a copy of your personal information; and (ii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine readable format (also known as the “right of data portability”);
- Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;

- Request Deletion of your personal information;

The DexCare Services may contain links to other websites/applications and other websites/applications may reference or link to our DexCare Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for the third party’s actions or omissions, including but not limited to their privacy practices, content of such other websites or applications, and errors or bugs in their software. Providing personal information to third-party websites or applications is at your own risk.
VIII. Children’s privacy
Only individuals 18 years of age or older are authorized to use the DexCare Services, either for themselves or on behalf of their minor children. We do not knowingly collect information directly from children under the age of 18. If you have reason to believe that an individual under the age of 18 has provided personal information to us through a DexCare Service, please contact us, and we will endeavor to delete that information from our databases unless we have a legal obligation to keep it.
IX. Retention of your Personal Information
We will store the personal information you provide for as long as we believe is necessary or appropriate (i) to carry out the purpose(s) for which we collected it, or (ii) to comply with applicable laws, contracts, or other rules or regulations.
To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.
X. California Residents
This Supplemental Notice for California Residents supplements our Privacy Notice and applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (as amended from time to time) (“CCPA”).
The CCPA provides California residents with the right to know what categories of personal information DexCare has collected about them, whether DexCare disclosed that personal information for a business purpose (e.g., to a service provider), whether DexCare “sold” that personal information, and whether DexCare “shared” that personal information for “cross-context behavioral advertising” in the preceding twelve months. Additional Privacy Rights for California Residents
Opting Out of “Sales” of Personal Information and/or “Sharing” for Cross-Context Behavioral Advertising under the CCPA. California residents have the right to opt out of the “sale” of personal information and the “sharing” of personal information for “cross-context behavioral advertising.” California residents may exercise these rights by DexCare by emailing DexCare at .
Disclosure Regarding Individuals Under the Age of 16. DexCare does not have actual knowledge of any “sale” of personal information of minors under 16 years of age. DexCare does not have actual knowledge of any “sharing” of personal information of minors under 16 years of age for “cross-context behavioral advertising.”
Disclosure Regarding Opt-Out Preference Signals. To download and use a browser that supports using an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal), click here: https://globalprivacycontrol.org/orgs. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.
Disclosure Regarding Sensitive Personal Information. DexCare only uses and discloses sensitive personal information for the following purposes:
- To perform the Services reasonably expected by an average consumer who requests such Services.
- To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, and or confidentiality of stored or transmitted personal information.
- To resist malicious, deceptive, fraudulent, or illegal actions directed at DexCare and to prosecute those responsible for those actions.
- To ensure the physical safety of natural persons.
- For short-term, transient use.
- To verify or maintain the quality or safety of a product, service, or device that is owned, manufactured, manufactured for, or controlled by DexCare, and to improve, upgrade, or enhance the service or device that is owned, manufactured by, manufactured for, or controlled by DexCare.
- For purposes that do not infer characteristics about individuals.
Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To authorize an agent, provide written authorization signed by you and your designated agent and contact us as set forth in “Contact Us” below for additional instructions.
Verification. To protect your privacy, we will take steps to reasonably verify your identity before fulfilling requests submitted under the CCPA. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to provide the email address or phone number we have associated with you, opening a link sent to the contact information provided, and following the instructions on the website you are taken to.

Pursuant to California’s “Shine The Light law (California Civil Code § 1798.983), California residents are entitled, once a year and free of charge, to request the disclosure of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year, if any. Under the law, a business should either provide California customers certain information upon request or permit California customers to opt out of this type of sharing.
